KATHMANDU — The government has brought an ordinance to release Resham Chaudhary, who is serving life imprisonment in the Tikapur incident.

The meeting of the Council of Ministers held on Sunday has decided to bring an ordinance to amend Section 116 of the National Civil Code Act 2017. Saying that this ordinance will release Resham from jail, a minister said: “Amnesty has not been said; it has been said that he will be removed from the negative list. However, the language has yet to be agreed”.

Section 116 of the National Civil Code Act 2017 provides that cases such as ‘death by inhumane manner or under control’ cannot be withdrawn. Due to this legal provision in Article 116 (2), the government could not withdraw the case of Resham Chaudhary and other leaders of his party and leaders and workers of the Biplav faction.

“Now it seems that they are trying to withdraw the case by revising this negative list to get a majority for the formation of the government,” said the source.

The parties in the ruling coalition are trying to get the majority (138 MPs’ support) in the House of Representatives to form a new government. It has sought the support of the Civil Liberties Party for that.

The top leaders of the ruling party themselves reached Dillibazar Jail and met Resham Chaudhary. Civil Immunity, on the other hand, has set a condition that the case of Chaudhary, the party’s patron, should be withdrawn to support the government.

A minister said that the government is trying to address the conditions of civil immunity by deciding to bring an ordinance on Sunday.

“If the ordinance is issued, the silk will be released. But the court should also accept it. I don’t know whether the court’s consent has been taken or not,” said the minister.
